General Terms and Conditions of Ludewig und Würffel GbR, Andreas-Schubert-Straße 23, 01069 Dresden, Germany, represented by Anton Ludewig and Marlon Würffel, Phone: +49 351 64829290, Email: hello@epicescape.co.uk, VAT ID No.: DE326917429 – hereinafter referred to as 'Epic Escape'.
§ 1 SCOPE AND DEFINITIONS
1. These General Terms and Conditions (GTC) apply exclusively to all business relations between Epic Escape and the customer (hereinafter referred to as the 'Customer') in the version valid at the time of the booking. Deviating or supplementary terms and conditions of the Customer are not recognized unless Epic Escape explicitly agrees to their validity in text form.
2. The Customer is a consumer insofar as the purpose of the requested delivery and service cannot be predominantly attributed to his commercial or independent professional activity. An entrepreneur, on the other hand, is any natural or legal person or partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding the contract.
§ 2 CONCLUSION OF CONTRACT
1. The contract is concluded exclusively with Ludewig und Würffel GbR, represented by Mr. Anton Ludewig and Mr. Marlon Würffel.
2. The Customer has the opportunity to start the booking process on the website epicescape.co.uk.
3. The booking process comprises the following steps:
(1) The Customer selects the desired experience via the 'Book' or 'Enquiry' button.
(2) The Customer selects the desired number of players, the preferred date, and an available time slot.
(3) By clicking the button to add the tour to the cart, the Customer can view single bookings, enter vouchers, or apply discount codes.
(4) Via the checkout button, the Customer proceeds to the order summary.
(5) In the order summary, the Customer enters personal details and selects the preferred payment method. Alternatively, express checkout options (e.g., Apple Pay, Google Pay, credit card) may be used. Before submitting the order, the Customer must confirm that they have read and accepted the Terms and Conditions and acknowledged the Privacy Policy.
(6) By clicking the final booking button ('Order with obligation to pay' / final checkout step), the Customer submits a binding offer to conclude a contract.
(7) Before sending the order, the Customer can change and view the data at any time or abort the process by closing the browser. The booking session automatically expires and aborts after 6 minutes of inactivity, without a contract being formed.
(8) Following the completion of the order, the Customer receives an automated contract confirmation via email. This contains the full order details, the text of these GTC, and the Privacy Policy in a durable format (email text or PDF attachment). This confirmation constitutes the formal acceptance of the contract offer.
4. The contract is concluded in the English language. The Customer confirms upon booking that they are of legal age. Participation is generally permitted from the age of 9. However, minors are only allowed to participate if accompanied by an adult supervisor.
5. Epic Escape also offers the opportunity to submit a non-binding booking enquiry via the contact form. Epic Escape will create a tailored proposal based on this request and send it via email. The Customer can review this proposal and complete the binding booking via the link provided in the email.
6. For the purchase of gift vouchers without a fixed date, the provisions of this Section apply accordingly, with the modification that no date or time slot is selected during purchase.
§ 3 PRICES AND SHIPPING
1. All prices stated on the website of Epic Escape are total prices and include the applicable statutory Value Added Tax (VAT), unless explicitly stated otherwise for B2B corporate client proposals.
2. Any shipping costs for physical corporate materials will be communicated in the order form and are to be borne by the Customer, unless the Customer exercises a statutory right of withdrawal.
3. Vouchers purchased online are delivered electronically via email to the email address provided by the Customer.
§ 4 PAYMENT TERMS
1. The Customer can make payments via Credit/Debit Card, PayPal, or – if explicitly offered in the proposal – by invoice (bank transfer). For payments by invoice, the total invoice amount is due within 14 calendar days from the date of the invoice, without deduction, unless individual terms have been agreed upon in text form.
2. Payment of the purchase price is due immediately upon conclusion of the contract unless otherwise agreed. If the Customer fails to pay by the specified due date, they shall automatically be in default. In this case, default interest shall be charged in accordance with statutory regulations.
3. For credit/debit card transactions, processing is handled securely via the external payment provider Stripe, Inc. For PayPal transactions, processing is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., subject to the respective provider's terms of service.
§ 5 LIABILITY
1. Claims of the Customer for damages are generally excluded. Exceptions include claims resulting from injury to life, body, or health, or from the breach of essential contractual obligations (cardinal duties), as well as liability for other damages based on an intentional or grossly negligent breach of duty by Epic Escape.
2. In the event of a slightly negligent breach of essential contractual obligations, Epic Escape shall only be liable for the foreseeable damage typical for this type of contract.
3. The Customer acknowledges that individual games take place entirely or partially outdoors and are exposed to weather conditions. Epic Escape accepts no liability for damage to clothing, equipment, or personal items caused by the Customer's own behavior or failure to follow safety instructions. Participants navigate the city at their own risk and must obey all local traffic and public safety regulations.
§ 6 WITHDRAWAL, CANCELLATION, AND SPECIAL RULES
1. Exclusion of the right of withdrawal for fixed-date services: Pursuant to the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (equivalent to § 312g Abs. 2 Nr. 9 BGB), there is no statutory right of withdrawal or cooling-off period for contracts concerning the provision of leisure activities if the contract provides for a specific date or period of performance. Bookings for a specific date are binding upon completion.
2. Goodwill Policy – Conversion into a Voucher: Without recognizing any legal obligation, Epic Escape offers a goodwill policy where a booking that the Customer cannot attend for personal reasons can be converted into a voucher equivalent to the booking value. The voucher is valid for three years, transferable, and cannot be paid out in cash. To qualify, the Customer must notify Epic Escape via email to buchung@epicescape.de at least 24 hours before the event starts, stating the booking number and full name. This goodwill policy explicitly excludes combo-products and add-on services as defined in paragraph 4.
3. Voluntary Money-Back Guarantee for Partial Non-Attendance: If the event takes place as scheduled and at least one booked person participates, Epic Escape will voluntarily refund the value for a maximum of one absent person. A refund is excluded if it would cause the group size to fall below the minimum booking threshold of 4 participants. The request must be submitted via email to buchung@epicescape.de within 48 hours after the event, providing the booking number and actual group size. Epic Escape reserves the right to request suitable proof (e.g., a medical certificate). This guarantee applies only to direct bookings.
4. Combo-Products and Add-on Services: Combo-products are offers combining the escape game with third-party services (e.g., a subsequent dinner or breakfast). Add-on services are independent features bookable only in conjunction with a game. These form an inseparable booking unit. Cancellation or conversion into a voucher is strictly excluded for combo-products and add-on services. Changes to the number of participants are permitted up to 14 calendar days before the event; after this deadline, no adjustments or refunds are possible under any circumstances.
§ 7 RIGHT OF WITHDRAWAL FOR NON-FIXED DATE SERVICES
1. While fixed-date escape games have no right of withdrawal (§ 6.1), statutory cancellation rights apply exclusively to services without a fixed date (such as gift vouchers without a specified date).
2. Cancellation Policy for Non-Fixed Date Services:
Right of cancellation: You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right to cancel, you must inform us (Ludewig und Würffel GbR, Andreas-Schubert-Straße 23, 01069 Dresden, Germany, Email: hello@epicescape.co.uk) of your decision to cancel this contract by a clear statement (e.g., a letter sent by post or email). You may use the model cancellation form below, but it is not obligatory.
Effects of cancellation: If you cancel this contract, we shall reimburse to you all payments received from you without undue delay and not later than 14 days from the day on which we are informed about your decision to cancel. We will carry out such reimbursement using the same means of payment as you used for the initial transaction.

§ 8 SPECIAL PROVISIONS AND WEATHER CONDITIONS
1. If an outdoor tour cannot take place because the relevant national weather service issues an official severe weather warning (such as an amber or red warning) for the specific time and location, the Customer will receive a voucher equivalent to the purchase price. A cash refund is excluded. Regular rain or wet weather conditions do not entitle the Customer to a refund or voucher. This weather clause does not apply to combo-products and add-on services (§ 6.4); no refunds or vouchers are granted for those.
2. Epic Escape is entitled to shorten the playing time of a tour if the Customer or the participants arrive late. There is no entitlement to a partial refund.
3. Participants must follow the instructions of the gamemaster and adhere to safety rules. In the event of gross violations, aggressive behavior, or severe intoxication, Epic Escape reserves the right to refuse entry or terminate the game immediately without a refund.
4. The Customer must inspect the provided equipment (e.g., tablets, puzzle cases) for completeness and damages upon handover. Epic Escape reserves the right to claim damages for lost or damaged equipment.
5. The technical equipment includes components such as mobile internet, GPS, and software. Epic Escape is not liable for temporary technical disruptions or server errors beyond its control, and such minor interruptions do not entitle the Customer to a price reduction. In the event of a total system failure directly attributable to Epic Escape that completely prevents the game from being completed or restarted within a reasonable time, the Customer is entitled to a full refund of the purchase price.
6. Both parties are entitled to withdraw from the contract in cases of force majeure (e.g., natural disasters, official authority closures, pandemics, strikes, or civil unrest) that make conducting the tour significantly difficult or impossible. If the Customer enters into the contract knowing that such an impediment is highly likely to occur on the event date, the Customer bears the full cancellation risk.
§ 9 INTELLECTUAL PROPERTY RIGHTS
1. All content provided by Epic Escape, including game concepts, riddles, texts, graphics, designs, software, apps, and audio/visual materials, is protected by copyright and intellectual property laws.
2. The Customer is not permitted to reproduce, distribute, publicly display, or modify the content beyond the contractually agreed purpose of participating in the booked game.
3. Recording or photographic documentation of specific riddle solutions, technical mechanisms, or core game secrets is strictly prohibited without explicit prior consent from Epic Escape.
§ 10 FINAL PROVISIONS
1. Contracts between Epic Escape and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory statutory provisions regarding the choice of law and consumer protection of the country in which the Customer has their habitual residence (e.g., the UK) remain unaffected.
2. If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be Dresden, Germany.
3. The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr. Epic Escape is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
